A true wonder note from the Newman Collection holdings, with this McHenry County bank having issued only Original and Series 1875 $5 notes before voluntarily liquidating at the expiration of its charter in 1882. No examples from this institution have ever been seen and, until this piece was consigned to us, none had even been rumored to exist. The bank was succeeded the following day by an identically titled institution whose notes are also unreported. The reason for this unusual sequence of events lay in a flaw in the enabling legislation that established the National Banking system. When the legislation was drafted, the drafters decreed that all charters would have a twenty-year life, with the expiration of charters for the first several hundred banks chartered set for early 1882. As this date drew near without corrective legislation having been enacted, the affected banks began to panic, as their corporate existence would be terminated without such legislation. Many filed applications for new charters, and more than a few actually entered into a voluntary liquidation, with some simply reorganizing under a new charter with, of course, a higher charter number, and others allowing their charters to lapse and assuming a new corporate identity with a new higher charter number. Much of this effort and expense was in vain, as the legislation that finally passed in July of 1882 extended the corporate lives of already existing National Banks by twenty years, grandfathering in those institutions that remained open under their old charters. Estimating unique items is always a challenge, as obviously no directly comparable items exist, but it would not surprise us at all to see this note fetch a figure in the mid to high four figures, and perhaps well over those numbers.
