State Archives of North Carolina"},{"label":"Language","value":["English"]},{"label":"Description","value":"The North Carolina Real Estate Licensing Board was created by the General Assembly in 1957.  The board was to be composed of five members, two of whom were to be licensed real estate brokers or salesmen.  A real estate broker was defined as a person, corporation, or firm who for compensation sold, auctioned, exchanged, bought, leased, or rented real estate.  A salesman was defined as any person who for compensation was engaged on behalf of a broker to perform any of these tasks.  Terms of board members were for three years, after initial staggered terms. Board members were to elect one of their number annually to serve as chairman.        The board was empowered to make any rules deemed necessary, employ a secretary-treasurer and clerical staff, have access to the services of the attorney general and his staff, and prescribe and administer  examinations for licenses for brokers and salesmen.  Those already  possessing licenses and in good standing for five years before the 1957  act's effective date were exempted from the examination requirement. Licenses were to be renewed annually. Fees were charged for each license issued or renewed.  The board also had the right to revoke or suspend licenses for various types of fraudulent or illegal conduct, such as willful misrepresentation, failing to account for money of others, and incompetence in the profession.  Those charged with violations had the right to hearings and eventual appeal to the superior court in the county of residence of the accused.  Non-resident real estate professionals who were licensed in other states could be authorized to transact business in North Carolina by paying the license fee.  In 1967 the General Assembly amended the 1957 act.  Additional reasons for license revocation were added, such as the failure to deliver within a reasonable time a completed copy of purchase agreements. The legislature also required that applicants be at least twenty-one years of age and that prospective brokers have at least six months experience as real estate salesmen prior to making application for licenses as real estate brokers.  Over the next ten years the legislature adopted several amendments to the statutes concerning the real estate profession.  Legislation was enacted requiring the Real Estate Licensing Board to maintain a current roster of all brokers and salesmen; expanding requirements for applicants for broker and sales licenses; authorizing the board to use funds for educational and information purposes and to enter into agreements with  other states; enlarging the definition of a broker to include a person or corporation who sells names of persons or corporations who have real estate for rental, lease, or sale; and permitting the refund of license fees in the event of the licensee's death, removal to another state, or voluntary surrender of the license.  In 1977 the Real Estate Licensing Board was included in the list of boards and commissions subject to review by the Governmental Evaluation Commission, or \"Sunset\" Commission.  Following that commission's recommendation, the legislature re-created the Real Estate Licensing Board in 1979.  The re-established board was to be composed of seven members appointed by the governor, two of whom were to be real estate professionals and two of whom were not to be connected  with the profession.  Members were to serve three-year staggered terms  and were annually to elect one of their number as chairman.  Most of the earlier legislation concerning powers and duties, applications and licenses, violations and hearings was retained; statutes affecting fees accompanying applications and renewals were amended; and the board was given the right to investigate the ethical background of candidates. The board could also inspect the records of brokers periodically without prior notice.  The 1979 session also established the Real Estate Recovery Fund. The Real Estate Licensing Board was to set aside one hundred thousand dollars to be used for the payment of unsatisfied judgments as determined by any court of competent jurisdiction where an aggrieved party suffered a direct monetary loss by reason of acts committed by licensed brokers or salesmen.  Additional legislation affecting the Real Estate Recovery Fund was enacted in 1987.  The second session of the 1979 General Assembly added the regulation and licensing of real estate schools to the list of responsibilities exercised by the Real Estate Licensing Board.  All private real estate schools were to be licensed annually by the board, provided they met certain standards concerning facilities, instructors, curriculum, and record-keeping policies.  Licenses could be revoked, suspended, or denied for just cause.  In 1983 the General Assembly amended real estate legislation to  change the name of the Real Estate Licensing Board to the Real Estate Commission.  The position of executive director was created, replacing the position of secretary-treasurer as chief administrative officer of the commission.  Additional legislation enacted in 1983 affected requirements for licensing and the establishment and regulation of  time shares as real property.  In 1989 the legislature established the North Carolina Real Estate Appraisal Board as an advisory agency to the Real Estate Commission, with authority to license and certify real estate appraisers.
