State Archives of North Carolina"},{"label":"Language","value":["English"]},{"label":"Description","value":"The years following the War Between the States witnessed efforts to standardize North Carolina's election laws.  From 1869 to 1879 the  General Assembly enacted a series of laws regulating the printing and  distribution of ballots and the supervision and conduct of elections in the state.  Prior to the creation of the State Board of Elections, the secretary of state had general statewide authority in this area.  In 1899 the General Assembly enacted legislation creating the State  Board of Elections and providing for the establishment of a statewide system of county election boards.  The State Board of Elections was to meet in April of each election year.  It was to consist of seven members selected by the legislature for two-year terms.  Once constituted, the state board was to elect one of its members chairman and another secretary.  Any vacancy occurring during a legislative recess was to be filled by the remaining board members.  The state board also had the  power to remove any member of a local board for incompetency, failure to perform duties, or other substantial cause, and to fill the vacancy so created. The State Board of Elections was charged with prescribing the size and color of paper ballots for state and national elections and notifying the chairmen of the state's political parties of those selections.  As security against possible election fraud, samples of the paper used were filed in the secretary of state's office and made available to state and local party chairmen. After official canvassing of election returns by county boards of canvassers, local election boards were to transmit certified abstracts of election returns for their counties to the state board and the secretary of state.  A state board of canvassers, composed of the governor,  secretary of state, and at least three members of the State Board of Elections, was to canvass and certify the statewide results.  The secretary of state was to record the official results and maintain  official election books for the state. County boards were also to transmit election results to the speaker of the state House of Representatives, who, in the presence of the majority  of the members of both houses of the General Assembly, was to open and  announce the returns for state offices the first Tuesday following the organization of the legislature after a general election. In 1901 the General Assembly amended the state's election laws.  The state board was to be composed of five members, each appointed by the governor for two-year terms.  Not more than three members were to be of one political party.  Vacancies occurring on the state board were to be filled by the governor for the unexpired term of the member replaced.   The legislature also stipulated that all ballots were to be printed on  white paper.  The state board would continue to prescribe the size of ballots for state, judicial, and congressional races, and the county  boards would perform the same task for county, legislative, and township contests.  Other duties and responsibilities of the state board remained the same. Laws regulating primary elections were enacted in 1915.  The State  Board of Elections was to meet on the tenth Saturday before state or district primary elections to appoint county boards, which, in turn, were to appoint local registrars and election judges.  The state board was to provide local boards with notices of candidacy to be filed by candidates desiring to run in state and county primary elections.  It was also to provide county registrars and election judges with printed election return forms, which, when completed in duplicate, were to be transmitted back to the state board. After compiling and tabulating returns for each election, the State Board of Elections was to publish the results and declare which primary candidates were elected as general election nominees for their respective parties.  Affidavits prepared by the county boards were to be filed with  the state board certifying the results of each election. The State Board of Elections was to promulgate a schedule for the entire primary election process and make necessary provisions for  recounts, including access to individual ballot boxes.  The state  treasurer was instructed to pay for expenses incurred in the conduct of primary elections. The law also authorized the state board to accept petitions to place  independent candidates on primary ballots and petitions to place new political parties on the ballot, setting requirements for numbers of  signatures needed in each case. In 1921 the General Assembly amended the state's general election laws to bring them more into conformity with primary election legislation.   The State Board of Elections, rather than the secretary of state, would provide forms for voter registration and result tabulation during general elections and would receive certified result forms from the county  boards.  All forms, blanks, and other printed materials were to be  prepared, printed, and transmitted by the state board.  In 1927 the legislature added that the state board was to furnish local boards with blank certificates and return envelopes to be used by absentee voters. In 1929 the secret ballot was required in all elections and primaries in North Carolina. The General Assembly again amended the state's election laws in 1933. Terms of state board members were increased to four years, all members were to be appointed by the governor and no political party was to have more than three members on the board.  The board was empowered to  maintain a minute book of all its proceedings, and was instructed to  make recommendations to the governor and General Assembly on improving the election process.  The state board had the authority to hear and act on all complaints; could determine the form of ballots, abstracts, and certificates; was directed to supply county boards with copies of all pertinent laws; was permitted to print any informative pamphlets to assist the electorate; and had the authority to qualify new political parties for access to the state ballot if the organization presented petitions signed by ten thousand registered voters.  Political parties would remain on the state ballot if they received at least three per cent of the vote in the previous presidential or gubernatorial election. The state board was constituted the legal state canvassing board for national, state, and district elections, including those in which a state senator was elected from a district consisting of more than one county. For local offices, the county boards performed this task.  At the  conclusion of the canvass, an election abstract was to be prepared, the result declared, and the secretary of state was to issue certificates of election for the successful candidates. The 1943 General Assembly enacted legislation regulating absentee  voting for members of the armed forces.  Applications from military personnel were submitted to the secretary of state, transmitted to the State Board of Elections, and then sent to the local boards, whose chairmen were to mail ballots to the applicants. In 1943 the legislature directed the state board to adopt a system of unitary voter registration.  Precincts were to use the same unified registration books for both primary and general elections.  Large  precincts were permitted to use loose-leaf registration books, a   privilege extended to all precincts in 1961. In 1965 the General Assembly created the Election Laws Revision  Commission and charged it with conducting a thorough study of the state's election statutes and preparing revisions of the laws as needed.   Composed of seven members appointed by the governor, lieutenant governor, and speaker of the state House of Representatives, the commission was to complete its work in two years and report to the 1967 legislature. Following the recommendations of the commission, the 1967 assembly recodified the state's election laws.  The state board continued to have general duties in supervising primaries and general elections. Meetings of the state board were to be called by the chairman whenever necessary, but two members could, in writing, call a meeting. In the late 1960s and 1970s additional responsibilities were conferred on the State Board of Elections.  It was empowered to render legal assistance to county election boards in litigation matters, to prescribe rules and procedures establishing a year-round voter registration system for the counties, to order new elections for members of the General  Assembly in the case of tie votes, to change the state's primary election dates from Saturdays to Tuesdays, to formulate rules for the reregistration of voters affiliated with political parties that have lost their legal ballot status, and to implement a rewriting of state laws regarding absentee ballots. In 1973 the General Assembly affirmed the independence and autonomy of the State Board of Elections.  Its executive secretary-director was to be named by the board to serve a four-year term and was to be responsible for all staffing, administration, and execution of the board's decisions. He or she was also responsible for the issuing of written rulings  regarding filing procedures and compliance with the state's campaign  contributions legislation.  No one was eligible to serve on the board who held current elective or appointive office, or any office in a political party or campaign. During the 1980s the state board was authorized to receive any  request from an eligible candidate for a run-off primary; to order a new election in the case of a contested election if based on a hearing and the findings of the county board; to approve petitions for the  establishment of a new political party if signed by the required  percentage of voters; and to permit voter registrations at Division of Motor Vehicles' license examiner offices.  The state board was to devise rules dealing with mistakes in straight party voting, to set new and accurate precinct boundaries coterminous with municipal and township  lines, to administer the North Carolina Candidates Financing Fund  contributed by taxpayer check-offs on annual tax forms, and to nominate  and place on the state's presidential preferential primary ballots those  candidates affiliated with a major party who were eligible to receive  federal matching funds.
