State Archives of North Carolina"},{"label":"Language","value":["English"]},{"label":"Description","value":"State regulation and registration of physical therapists originated in 1951 with the creation of the State Examining Committee of Physical  Therapists.  The committee consisted of five members appointed by the governor, including one doctor and four physical therapists, the latter selected from a list of candidates submitted by the North Carolina  Physical Therapy Association, Inc.  To qualify for membership on the committee, a physical therapist had to be registered, a resident of the state, and actively engaged in the practice for at least three years.   The initial appointees served staggered terms; their successors held  office for three years.  The North Carolina Physical Therapy Association, Inc., was directed to provide the committee with the necessary clerical assistance.  The committee was empowered to create, conduct, and evaluate  examinations of candidates for registration.  It was also directed to maintain a record of its proceedings and a register of certified  practitioners, which was to be open to public inspection.  The  examination was to include elements of anatomy, kinesiology, physiology, pathology, psychology, physics, medical ethics, and technical procedures of physical therapy.  Minimum qualifications to sit for examination included twenty-one years of age, good moral character, a high school diploma or the equivalent, and graduation from an approved school of physical therapy.  The committee was to issue a certificate of registration upon successful completion of the exam.  Physical therapists actively engaged in practice could be grandfathered in provided they met qualifications established by the American Physical Therapy Association. Practitioners registered in another state could apply for certification without examination.  Certificates had to be renewed each January.  The enabling legislation specified grounds upon which the committee could refuse or revoke registration, including habitual drunkenness, addiction to narcotics or violation of narcotic laws, fraud or  misrepresentation in applying for certification, and actions derogatory to professional standards, such as practicing independently of a medical doctor.  False representations as a registered therapist and fraudulent attempts to obtain a certificate were declared misdemeanors.  The enabling statute was amended in 1959.  The minimum age requirement for examination was deleted.  Graduate students engaged in a physical therapy practicum were not required to be registered, even if they  received a small stipend for their labors.  A foreign-trained therapist could be issued a temporary license to practice in the state for up to six months.  Ten years later, the general statute governing state regulation of physical therapists was completely rewritten.  The committee was  re-created as the North Carolina State Examining Committee of Physical Therapy, consisting of seven members appointed by the governor upon recommendation of the North Carolina Physical Therapy Association, Inc. The two additional members were to be physical therapy assistants, an  occupation defined by the statute.  The committee was authorized to  certify assistants, who were required to have graduated from a  specialized program before sitting for the exam.  The committee was also  empowered to employ its own clerical assistance, paid for from  examination fees.  The examining committee was one of the many state occupational  licensing agencies targeted in 1977 for review by the Governmental  Evaluation Commission (Sunset Commission).  It was tentatively scheduled for termination on 1 July 1981.  However, before the commission completed its appraisal of the committee, the enabling statute was rewritten.  In 1979, the regulatory agency for physical therapists was re-created and renamed the North Carolina Board of Physical Therapy Examiners.  Its  powers were broadened to permit investigations into possible violations of the statute or other grounds for discipline, administrative hearings for contested board decisions, and applications to superior court for  temporary restraining orders or permanent injunctions to curtail illegal practices.  The revised statute also contained a clause advocating a liberal construction of the powers of the board in order to safeguard the public health, safety, and welfare.  Grounds for disciplinary action were expanded to include insanity, incompetence, the commission of malpractice or gross negligence, and conviction of a felony involving moral turpitude.  Practitioners exempted from registration included physical therapy aides, an occupation subordinate to physical therapy assistants.  In 1980, the Governmental Evaluation Commission concluded that the board should be continued as reconstituted, but with two revisions to its membership:  the addition of two public members, and provision for an open pool of candidates from which the governor could make appointments, unrestricted by recommendations of the profession.  In 1981, board membership was increased to eight with the addition of one public member appointed by the governor.  However, the North Carolina Physical Therapy Association, Inc. retained control of the list of potential appointees from among its membership.  The lieutenant governor and speaker of the House were each granted appointment of one of the physical therapist board members, but absolute appointment power reverted to the governor in 1985.
