In October of that same year he was captured at Hillsborough by the Tory Raider David Fanning. Burke was paroled to James Island but when his life was threatened by Tory refugees he fled and made his way back to North Carolina, where he resumed his duties as governor. Resuming his duties as Governor of North Carolina was considered a parole violation and created criticism among the military officers who felt that this was a breach of honor.
